1. INTRODUCTION

Meritus College (“us”, “we”, “our”, or “Meritus College”) operates the merituscollege.org website (the “Site” and various services, provided by use of platforms or other means of delivery (the “Services”). Each of these terms has the same meaning as set forth in the Terms and Conditions, to which this Policy is incorporated by reference. This privacy policy (“Privacy Policy”) informs you of the types of data that we gather when you use the Site and/or Services, our policies regarding the collection, use and disclosure of certain personally identifiable information that you provide and that we collect. This information can be used to contact or identify you or your household, directly or indirectly, by reference to identifiers such as your name, location data, online identifier or one or more factors specific to your physical, physiological, genetic, mental, economic, cultural, educational, commercial, professional or social identity (“Personal Data”), each of which you may be requested or required to provide as a condition of receiving the Services. This Policy also outlines the choices you have associated with respect to your use of Personal Data as it pertains to your use of the Site or Services.

Each time you use our Site or Services, the current version of the Privacy Policy will apply.  Accordingly, whenever you use our Site or Services, you should check the date of this Privacy Policy (which appears at the top) and review any changes since the last version.  This Privacy Policy is applicable to all Site visitors, registered users, and all users of our Services. Meritus College reserves the right to update, modify, alter, amend or otherwise change or replace this Privacy Policy, as per the terms provided herein. By continuing to use the Site or Services after the effective date of this Privacy Policy, as it appears above, you hereby acknowledge and agree to all terms of this Privacy Policy.

Further, you acknowledge that this Privacy Policy is part of our Terms and Conditions.  This Privacy Policy is incorporated within the Terms by reference, and by accessing or using our Services, you agree to be bound by the Terms and Conditions. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in the Terms and Conditions.  If you do not agree to our Terms or the Privacy Policy, you are not permitted to use our Site or Services.

2. DATA COLLECTION

We collect several different types of information that you knowingly and voluntarily provide when you use our Site or Services, including through forms or submission fields, and at various stages, such as registration and account setup.   • A. Personal Data. While using our Service, from time to time, we may ask or offer you the option to provide us with certain Personal Data. For required Personal Data: you may choose not to provide us with that such required Personal Data, but you may be prohibited from using the Site or Services or may be restricted or otherwise unable to use certain features or aspects of the Site or Services.  Personal Data that we may collect, pursuant to applicable law and regulations, includes but is not limited to : (i) email address; (ii) names; (iii) phone numbers; (iv) address, state, province, postal codes, and other geographical identifiers; (v) date; (vi) educational history; (v) self-reported income and employment information, including but not limited to current place of employment and salary; and (vi) information made available through web-based data, including by use of cookies or other similar commonly used technologies.
  • B. Usage Data. Consistent with your permissions and browser or system settings, and as permitted by applicable law, we may collect information that is sent to us automatically by your web browser, including online activity, browser plug-in details, operating system, referring site(s), and language preferences (“Usage Data”). Usage Data may also include additional information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Site or Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. All or part of such data may be designated as required by Meritus College, and blocking the collection of Data, manually or by use of applications or external plug-ins, may restrict your use of the Site or Services. We may suspend your use of the Site or Services should we detect use of any such applications or plug-ins, and may request that you remove such applications or plug-ins from use prior to the reinstatement of your access to our Site or Services. 
  • C. Tracking and Cookies Data. We obtain information about you by installing cookies or similar, commonly used tracking technologies on your computer’s local drive. “Cookies” are files with a small amount of data which may include an anonymous unique identifier which are sent to your browser from a website and stored on your device. We use cookies to track the activity on our Site and Services. Other tracking technologies commonly used include beacons, tags and scripts, and are used to collect and track information, primarily to improve and analyze our Service but also for marketing purposes. and we hold certain information. Meritus College uses the collected data for various purposes, including to: (i) Provide and maintain our Site and Services; (ii) notify you about changes to our Site or Services; (iii) permit you to participate in interactive features of our Site or Services at your option or as part of your use of the Site or Services; (iv) provide user or other support; (v) gather analysis or valuable information so that we can improve our Site or Services for your use; (vi) monitor the use of our Site or Services; (vii) detect, prevent and address technical issues; (viii) Provide you with news, special offers and general information about products, platforms, offerings, courses, or other Services that we offer; (ix) comply with applicable legal or regulatory requirements; and (x) to otherwise fulfill our obligations to you under any terms that apply to your use of our Site or Services.

4. RETENTION OF DATA

To the maximum extent permitted under applicable law, we shall retain your Personal Information for such period as is reasonably necessary to accomplish the specific purpose for which such information was collected, and in accordance with the terms of this Privacy Policy. Notwithstanding the foregoing, we may retain your Personal Information for a longer period where such retention is required by applicable law, or where it is necessary to satisfy a legitimate interest or any other lawful basis, including, without limitation, the establishment, exercise, or defense of legal claims. In circumstances where the sole legal basis for processing is your consent, we shall, upon the withdrawal of such consent, delete the relevant Personal Data without undue delay. 5. TRANSFER OF DATA

Personal Data provided by you may be transferred to, and stored in, jurisdictions other than your state or country of residence, except as may be restricted by applicable law. Your Personal Data may also be processed by employees, agents, contractors, or other third parties engaged by us, as well as by representatives, employees, or workers of Meritus College, who may be situated outside your state or country of residence. Where we transfer your Personal Data to any third parties, such transfers shall be effected only where the recipient provides an adequate level of protection in accordance with the data protection laws applicable to you, and, where required, appropriate safeguards shall be implemented. Furthermore, Meritus College shall take all reasonable and lawful measures to protect your privacy and Personal Data in accordance with the applicable law.

Furthermore, we may be required to disclose your Personal Data if mandated by applicable law or pursuant to valid legal requests from public authorities (including, without limitation, a court, law enforcement body, or governmental agency). We may also disclose your Personal Data where it has a good faith belief that such disclosure is necessary to: (i) comply with a legal obligation; (ii) protect or defend the rights, property, or safety of Meritus College, its affiliates, users, or the public; (iii) prevent or investigate potential wrongdoing in connection with the Site or Services; or (iv) protect against legal liability.

Meritus College does not sell your personal information to third parties for their use in direct marketing, advertising, or promotion of their products or services without your explicit consent.

8. SECURITY OF PERSONAL DATA

Meritus College is committed to protecting your personal information and uses physical, administrative, and technical safeguards to prevent unauthorized access, use, or disclosure. While we strive to use industry-standard security measures, no method of transmission or storage is completely secure, and we cannot guarantee absolute protection against illegal or unauthorized access of data.

9. DO NOT TRACK

We do not recognize or respond to the “Do Not Track” (“DNT”) setting or signal that may be transmitted by certain web browsers. DNT is a browser-based preference that allows users to indicate to websites and online services that they do not wish to be tracked. Your use and navigation of the Site or Services may be monitored as part of the collection of quantitative and analytical user information. In the event you access the Site or Services via a link from a third-party website or service that honors DNT signals, any recognition of a DNT request initiated by you will cease immediately upon your entry to the Site or Services.

Such third-party service providers may be engaged for purposes including, without limitation: (i) payment and donation processing; (ii) enhancing protection against fraud, abuse, and security risks; (iii) marketing, promotional, and analytics activities; (iv) processing employment applications; (v) processing admission applications; (vi) alumni outreach and engagement; (vii) event registration and coordination; (viii) course registration and coordination; (ix) course evaluations and assessments; (x) research, insights, and analytics; and (xi) human resources administration.

12. CHILDREN ONLINE PRIVACY PROTECTION

The Service is not intended for, and is not directed to, individuals under the age of eighteen (18). We do not knowingly collect Personal Data from underage individuals. If you are a parent or legal guardian and become aware that a child in your care has provided Personal Data to Meritus College, you are requested to contact us promptly at info@merituscollege.org.

In the event that we become aware that it has collected Personal Data from a child through the Site or Services without verified parental consent, we shall take all reasonable steps, consistent with applicable law, to delete such information from its records without undue delay.

Meritus College reserves the right, in its sole discretion, to amend, modify, or replace this Privacy Policy at any time and for any reason.
